These Terms of Service ("Terms") govern your access to and use of Plutux, including our website, applications, products, tools, data features, AI-assisted analysis features, subscription plans, credit-based usage system, and related services (collectively, the "Service").
These Terms form a legally binding agreement between you and Plutux ("Plutux," "we," "us," or "our"). By accessing or using the Service, creating an account, purchasing a subscription, purchasing credits, or using any Plutux feature, you agree to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
1. About Plutux
Plutux provides tools for trading-system construction, market research, strategy organization, data-assisted analysis, and AI-assisted interpretation based on stock and market-related data.
Plutux is a technology and research platform. Plutux does not provide personalized investment, financial, legal, tax, or trading advice.
Any information, analysis, output, data visualization, trading-system result, backtest result, AI-generated content, or other material provided through the Service is for informational and educational purposes only.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
By using the Service, you represent and warrant that:
- you have the legal capacity to enter into these Terms;
- your use of the Service complies with applicable laws and regulations;
- you are not prohibited from using the Service under applicable sanctions, export-control rules, or other legal restrictions;
- all information you provide to us is accurate, current, and complete.
3. Accounts
To access certain features, you may need to create an account.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account;
- keeping your account information accurate and up to date;
- promptly notifying us of any unauthorized access or suspected security breach.
You may not share, sell, rent, transfer, or allow unauthorized use of your account.
We may suspend or terminate your account if we believe that your account has been used in violation of these Terms, for fraud, abuse, unauthorized access, excessive automated use, security risk, or other harmful activity.
4. Subscriptions, Credits, and Paid Features
Plutux may offer paid access through subscriptions, one-time credit purchases, feature-based plans, or other paid products.
4.1 Subscription Plans
A subscription plan may provide access to specified features, tools, usage limits, account capabilities, and a specified amount of internal credits during each billing period.
Subscription plans may differ by:
- available features;
- number of included credits;
- credit refresh cycle;
- usage limits;
- data access level;
- AI analysis capacity;
- saved projects, systems, or workspaces;
- export, sharing, or collaboration features;
- other plan-specific benefits.
The specific features, credit amounts, limitations, and pricing of each subscription plan will be shown at the time of purchase or within the applicable product interface.
4.2 Internal Credits
Plutux may use an internal credit system to measure or enable usage of certain features.
Credits may be used for activities such as:
- AI-assisted analysis;
- market-data analysis;
- trading-system generation or review;
- backtesting or simulation features;
- report generation;
- data-intensive requests;
- premium research tools;
- other credit-based product features.
Credits are an internal product-use measurement only. Credits are not money, legal tender, stored value, securities, gift cards, cryptocurrency, or financial instruments.
Credits have no cash value and may not be sold, transferred, exchanged, withdrawn, redeemed for money, or used outside the Service.
4.3 Subscription Credits
Certain subscription plans may include a specified number of credits during each billing period.
Unless otherwise stated:
- subscription credits are provided as part of the active subscription plan;
- subscription credits may refresh according to the billing cycle or plan terms;
- unused subscription credits may not roll over to future billing periods;
- unused subscription credits may expire at the end of the applicable billing period;
- subscription credits may be lost if the subscription is cancelled, expires, is downgraded, or is terminated.
The exact credit rules for a plan may be shown in the product interface, checkout page, pricing page, or account dashboard.
4.4 One-Time Credit Purchases
Plutux may allow users to purchase additional credits directly.
One-time purchased credits may be used for eligible credit-based features within the Service.
Unless otherwise stated at the time of purchase:
- purchased credits are non-refundable;
- purchased credits are non-transferable;
- purchased credits do not create ownership rights in the Service;
- purchased credits may expire after a stated period;
- purchased credits may be subject to usage restrictions, technical limits, or anti-abuse rules.
If a credit expiration period applies, it will be disclosed at or before purchase or within the account dashboard.
4.5 Feature Access
Some features may require:
- an active subscription;
- a specific subscription tier;
- sufficient credits;
- a one-time purchase;
- user verification;
- compliance with usage restrictions;
- availability of third-party data or integrations.
Purchasing credits does not automatically grant access to all paid features. Some features may require both an eligible subscription plan and sufficient credits.
Similarly, having an active subscription does not guarantee unlimited usage. Certain features may still consume credits, have usage caps, or be subject to fair-use limits.
4.6 Credit Consumption
Credit consumption may vary depending on the feature, data volume, request complexity, AI model usage, market-data usage, computation cost, or other operational factors.
Plutux may display estimated or actual credit consumption before or after a feature is used. Estimates may differ from actual usage.
We may update credit costs, credit allocation rules, usage limits, or feature requirements from time to time. Changes will apply prospectively unless otherwise required by law.
4.7 No Cash Redemption
Credits cannot be redeemed for cash, transferred to another user, resold, exchanged for other products outside the Service, or refunded except where required by applicable law or expressly stated by Plutux.
5. Billing and Payment
5.1 Payment Providers
Payments may be processed by third-party payment providers, including Stripe, PayPal, Apple, or other providers made available through the Service.
By making a purchase, you agree to the applicable payment provider’s terms, payment rules, and privacy practices.
Plutux does not store full payment card numbers, bank account numbers, or complete payment credentials on its own servers.
5.2 Fees
You agree to pay all fees, charges, taxes, and other amounts associated with your purchases, subscription plans, credit purchases, or other paid services.
Prices may be shown in U.S. dollars or another currency depending on your location, payment provider, or checkout interface.
You are responsible for any applicable taxes, duties, exchange fees, bank fees, or payment-provider charges.
5.3 Automatic Renewal
Unless stated otherwise, subscriptions automatically renew at the end of each billing period.
By purchasing a subscription, you authorize Plutux and its payment providers to charge your selected payment method for recurring fees, applicable taxes, and other charges until you cancel.
5.4 Failed Payments
If a payment fails, we may:
- attempt to charge the payment method again;
- ask you to update your payment information;
- suspend or limit access to paid features;
- reduce or remove subscription benefits;
- terminate the subscription;
- prevent further credit-based usage until payment is resolved.
5.5 Price Changes
We may change subscription fees, credit prices, plan structures, included credits, feature access, or billing terms.
For existing subscriptions, price changes will apply at the next renewal date or as otherwise communicated, unless applicable law requires a different approach.
If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
6. Cancellation, Refunds, and Expiration
6.1 Cancellation
You may cancel your subscription through your account settings, payment dashboard, app store subscription settings, or by contacting support if self-service cancellation is unavailable.
Cancellation stops future renewals. Unless otherwise stated or required by law, cancellation does not automatically refund fees already paid.
After cancellation, your paid access may continue until the end of the current billing period.
6.2 Refunds
Unless otherwise required by applicable law or expressly stated by Plutux:
- subscription fees are non-refundable;
- one-time credit purchases are non-refundable;
- unused credits are non-refundable;
- partially used billing periods are non-refundable;
- unused subscription benefits are non-refundable;
- promotional purchases, discounted purchases, and special offers are non-refundable.
We may choose to provide refunds, credits, or exceptions at our discretion. Providing an exception in one case does not require us to provide the same exception in another case.
6.3 App Store Purchases
If you purchase a subscription or credits through Apple, an app store, or another third-party platform, billing, cancellation, and refunds may be handled by that platform.
In such cases, you may need to manage cancellation or refund requests directly through the applicable platform.
6.4 Account Termination and Credits
If your account is suspended or terminated due to violation of these Terms, fraud, abuse, unauthorized use, chargeback abuse, or illegal activity, you may lose access to subscriptions, credits, saved content, and paid features, without refund, to the maximum extent permitted by law.
7. Market Data and Third-Party Data
The Service may display, process, analyze, or rely on market data, stock data, financial information, company information, news, prices, indicators, or other third-party data.
Such data may come from third-party data providers, public sources, APIs, exchanges, or other sources.
Plutux does not guarantee that market data or third-party data will be accurate, complete, current, uninterrupted, error-free, or suitable for your specific purpose.
Market data may be delayed, incomplete, inaccurate, unavailable, or subject to provider restrictions.
You agree that Plutux is not responsible for losses, decisions, or actions based on market data, AI-generated outputs, or third-party information.
8. AI-Assisted Features
Plutux may provide AI-assisted features, including analysis generation, trading-system review, market interpretation, summaries, explanations, reports, prompts, or other automated outputs.
AI-generated outputs may be inaccurate, incomplete, outdated, misleading, or unsuitable for your situation.
You are responsible for independently reviewing, verifying, and evaluating all AI-generated outputs before relying on them.
Plutux does not guarantee:
- the accuracy of AI outputs;
- the profitability of any trading system;
- the reliability of any analysis;
- the suitability of any result for your personal financial circumstances;
- that any AI output will meet your expectations or investment objectives.
AI outputs are not investment advice, financial advice, trading advice, tax advice, legal advice, or a recommendation to buy, sell, hold, short, trade, or avoid any security, asset, or financial instrument.
9. No Investment Advice
Plutux is not a registered investment adviser, broker-dealer, financial planner, tax adviser, legal adviser, or fiduciary.
The Service does not provide personalized investment advice or recommendations.
Nothing on the Service should be interpreted as:
- a recommendation to buy, sell, hold, short, or trade any security or asset;
- a solicitation or offer to buy or sell securities;
- investment advice;
- financial planning advice;
- tax advice;
- legal advice;
- risk-management advice tailored to your personal situation;
- a guarantee of future performance.
All trading and investing involve risk, including the possible loss of principal.
Past performance, backtested performance, simulated performance, hypothetical performance, or AI-generated analysis does not guarantee future results.
You are solely responsible for your own financial, trading, and investment decisions.
You should consult qualified financial, legal, or tax professionals before making investment decisions.
10. User Content
You may submit, create, save, generate, upload, share, publish, or display content through the Service, including prompts, trading-system configurations, watchlists, strategy parameters, notes, reports, analyses, comments, shared links, or other materials ("User Content").
You retain ownership of your User Content, subject to the license granted below.
By using the Service, you grant Plutux a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, and use your User Content only as reasonably necessary to:
- provide the Service;
- operate your account;
- generate requested outputs;
- save and display your content;
- enable sharing features you choose to use;
- troubleshoot technical issues;
- maintain security;
- comply with law;
- enforce these Terms.
Plutux does not use your saved account content to train AI models unless you separately consent or opt in through a clearly provided product setting.
You are responsible for ensuring that your User Content does not violate any law, third-party rights, confidentiality obligations, intellectual-property rights, privacy rights, or these Terms.
11. Sharing Features
Plutux may offer features that allow you to share selected content, including trading systems, watchlists, analysis results, reports, exports, links, screenshots, or other account-generated materials.
Plutux does not share your User Content by default.
Sharing occurs only when you take an affirmative action, such as choosing to share, publish, export, invite, connect, generate a shared link, or otherwise authorize access.
When you use a sharing feature, your shared content may become accessible to:
- invited users;
- recipients;
- workspace members;
- users with access to a shared link;
- connected third-party services;
- other persons depending on the sharing settings you select.
You are responsible for reviewing what you choose to share and for managing permissions, recipients, access settings, and shared links.
If someone accesses, copies, downloads, screenshots, exports, or further shares content that you made available, Plutux may not be able to fully recover or delete that content.
12. Acceptable Use
You agree not to misuse the Service.
You may not:
- violate applicable laws or regulations;
- use the Service for fraud, market manipulation, deception, or illegal activity;
- attempt to gain unauthorized access to systems, accounts, data, or networks;
- interfere with or disrupt the Service;
- reverse engineer, decompile, or attempt to extract source code, models, prompts, systems, or non-public technology;
- scrape, crawl, harvest, or extract data except as expressly permitted by Plutux;
- bypass rate limits, credit limits, usage limits, security controls, or access restrictions;
- resell, sublicense, rent, lease, or commercially exploit the Service without authorization;
- use automated scripts, bots, or high-volume requests in a way that harms or burdens the Service;
- upload malware, harmful code, or malicious content;
- infringe intellectual-property rights or privacy rights;
- use the Service to create competing products or services using unauthorized access to Plutux systems, outputs, or data;
- misrepresent AI-generated outputs as guaranteed, official, or professional financial advice.
We may monitor usage to detect abuse, protect the Service, enforce usage limits, and maintain platform reliability.
13. Fair Use and Usage Limits
Subscriptions, credits, and feature access are subject to reasonable use, technical limits, rate limits, anti-abuse controls, and availability.
Even where a feature is described as high-volume, extended, or unlimited, we may limit, suspend, throttle, or restrict usage that we believe is abusive, excessive, harmful, automated, fraudulent, technically disruptive, or inconsistent with normal individual use.
We may apply usage limits based on:
- plan type;
- credit balance;
- feature type;
- request frequency;
- data volume;
- computational cost;
- security risk;
- third-party provider limits;
- market-data licensing limits;
- system capacity.
14. Intellectual Property
The Service, including software, design, text, graphics, logos, interfaces, workflows, databases, models, product names, features, and other materials, is owned by Plutux or its licensors and is protected by intellectual-property and other laws.
Except as expressly allowed under these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, create derivative works from, or exploit any part of the Service.
Subject to your compliance with these Terms, Plutux grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes.
No rights are granted except as expressly stated in these Terms.
15. Feedback
If you submit feedback, suggestions, ideas, feature requests, comments, or recommendations, you grant Plutux the right to use them without restriction, compensation, or obligation to you.
We may use feedback to improve, develop, modify, market, or commercialize the Service.
16. Third-Party Services
The Service may include or integrate with third-party websites, APIs, data providers, payment providers, brokers, analytics tools, authentication tools, cloud services, app stores, or other third-party services.
Your use of third-party services may be subject to their own terms and privacy policies.
Plutux is not responsible for third-party services, including their content, data, accuracy, availability, security, pricing, policies, or practices.
We do not guarantee continued availability of any third-party integration.
17. Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Plutux disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.
Plutux does not warrant that:
- the Service will be uninterrupted, secure, error-free, or available at all times;
- market data will be accurate, complete, current, or uninterrupted;
- AI outputs will be accurate, complete, useful, or suitable for your purpose;
- trading systems created through the Service will be profitable;
- backtests, simulations, or historical results will reflect future performance;
- defects or errors will be corrected;
- the Service will meet your expectations.
You use the Service at your own risk.
18. Limitation of Liability
To the maximum extent permitted by law, Plutux and its officers, directors, employees, contractors, affiliates, suppliers, licensors, service providers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including damages for lost revenue, lost data, lost business, trading losses, investment losses, loss of goodwill, service interruption, or financial loss.
To the maximum extent permitted by law, Plutux’s total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:
- the amount you paid to Plutux for the Service during the three months before the event giving rise to the claim; or
- USD $100.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
19. Indemnification
You agree to indemnify, defend, and hold harmless Plutux and its officers, directors, employees, contractors, affiliates, suppliers, licensors, service providers, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use or misuse of the Service;
- your violation of these Terms;
- your violation of applicable law;
- your User Content;
- your sharing or publication of content through the Service;
- your trading, investment, or financial decisions;
- your violation of third-party rights;
- unauthorized use of your account.
20. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service at any time if we believe that:
- you violated these Terms;
- your use creates security, legal, technical, or operational risk;
- your payment fails or is disputed;
- your account is involved in fraud, abuse, unauthorized access, or illegal activity;
- continued access may harm Plutux, users, third parties, or the Service.
You may stop using the Service at any time.
Termination does not relieve you of payment obligations incurred before termination.
Sections that by their nature should survive termination will survive, including provisions relating to payments, credits, intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.
21. Changes to the Service
We may modify, suspend, discontinue, replace, or limit any part of the Service at any time.
This may include changes to:
- features;
- subscription plans;
- credit costs;
- included credits;
- usage limits;
- data sources;
- AI models;
- integrations;
- availability;
- pricing;
- product design.
We are not liable for changes, suspension, or discontinuation of the Service, except where required by applicable law.
22. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may provide notice through the Service, email, or other reasonable means.
The updated Terms will become effective when posted, unless a later effective date is stated.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and cancel any subscription before the changes apply to you.
23. Privacy
Your use of the Service is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, and protect information.
By using the Service, you also acknowledge the Privacy Policy.
24. Governing Law
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles.
25. Dispute Resolution
Before filing a legal claim, you agree to first contact us at support@plutux.ai and attempt to resolve the dispute informally.
If a dispute cannot be resolved informally, the dispute will be handled in the state or federal courts located in Nevada, unless applicable law requires otherwise.
You and Plutux consent to the personal jurisdiction and venue of those courts.
26. Miscellaneous
These Terms constitute the entire agreement between you and Plutux regarding the Service.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce any provision is not a waiver of our right to enforce it later.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
No person or entity other than you and Plutux has rights under these Terms, except where expressly stated.
